Who is the head of the Maldives Police Service?

A few hours ago, it emerged (and is now reported on the police website) that Adam Zahir has resigned from his position as the Commissioner of Police upon being asked by HEP Nasheed to do so. This would not be a surprise to anyone and was very much expected.

It has also been reported that Ahmed Faseeh has been appointed the Inspector General of Police. His appointment was announced together with that of Brig. Moosa Jaleel who has been appointed as the Chief of Defense Force in replacement of Mohamed Zahir who I assume resigned in the same manner as Adam Zahir.

On the face of it, there seem to be no issues as it seemed that HEP Nasheed has appointed the two most senior officers to the two uniformed services.

However, on close inspection of the Police Act, it does not appear to do so.

Clause 52 (c) of the Police Act states that the most senior officer of the Police Service is the 'Commissioner of Police' and Clause 54 (c) of the same act provides that the Deputy Commissioner of Police is the second most senior officer of the Police Services.

Now that Adam Zahir has resigned, up until a new Commissioner of Police is appointed, the Deputy Commissioner of Police is by force of law, the most senior officer in the Police Service, and therefore by appointing Faseeh as the 'Inspector General of Police'- does not make him the head of the Police Force.

He has to be given the rank of Commissioner of Police for him to be the most senior officer in the Police Service under the Police Act.

UPDATE: Ahmed Faseeh has subsequently been appointed as the 'Commissioner of Police'. No issues now.

Brig. Jaleel not only qualifies for the post due to him being the second most senior officer. Theres no one in the maldivian military (including Maj. Gen Mohamed Zahir) who can be compared to Brig. Jaleel in terms of military training and experience. Particularly his bravery and actions during the November 3rd.

My only concern is the new Defence Minister. I wonder how the military coulk look up to their new Defence Minister when he had brought disgrace to the military service and the uniform it holds so dearly.

The current commissioner of police Ahmed Faseeh is accused of torturing detainees. He is accused of being involved in the torture of Abdulla Mahir whose backbone was broken. These allegations must be investigated by our parliament and if there is a truth to those allegations, Faseeh should be fired.

Adam Zahir simply was the best!!! There was a lot of improvement in police services while he was there..We shouldn,t forget the good deeds!!!

Apparently they thought that Adam Zahir would not resign when asked so they initially issued Faseeh with the rank of Inspector General thinking it was higher than the Commissioner of Police but in Civilian Police Authority and according to the Police Act, The Commissioner is the ultimate in charge of the Police, not some military rank of Inspector General. Adam Zahir was and still is the best candidate as Commissioner of Police and it was unfortunate as the only person who could not bribed, was made a scapegoat for change instead. These are the doings of corrupt individuals such as Hassan Saeed who want one up over people who have shamed their wrongdoings in the past. I pay tribute to Adam Zahir and Maldives Police Service for its professionalism over the past five years since its separation from the MNDF. Even Faseeh will admit he is not the man for the job.
